may be this variable capacitor has two capacitors in one body, and they share the middle leg.The two capacitors can have different values.use only two legs for using one of the capacitors

Its a standard Philips part. The two legs opposite each other are joined together. Three legs are used rather than two to give it better mounting stability and to reduce the inductance of the pins.

If I remember right, you can see this by taking one sharp look on the bottom side. (not to mention an ohmmeter)
