Why do you need a the mute pin 5 connected to Vcc via a transistor (BSX33)?

Why couldn't you just connect it directly to Vcc assuming you don't need the ability to turn the sound on and off?

If you don't need the mute function and will always have the sound playing, just connect mute to ground (not VCC).

Have you gone through the datasheet (http://www.datasheetcatalog.org/datasheet/SGSThomsonMicroelectronics/mXtzzzq.pdf)?

On page 6, you can find this:
