FCC intentional vs. unintentional radiator

Does an intentional radiator (say a Wi-Fi device) use the same criteria (radiated emission level) as an unintentional radiator for frequencies outside the intentional radiators frequency?

The EMC plots I have seen start at 30MHz, so for a 13.56MHz RFID system, is it correct to assume the 3rd harmonic must be below 40dBuV/m @ 40.7MHz ?
 

The FCC doesn't care where your emissions come from. Intentional or unintentional, they both must meet the FCC mandated emissions mask. It is the responsibility of the FCC package submitter to insure that all emissions are below the mandates.

As above, its pretty much free what you can do within the ISM band, but radiation outside the ISM band must fall within mandated limits.
